California Instacart shopper misclassification $46.5M lawsuit settlement (12)

Instacart agreed to pay $46.5 million to resolve a California attorney general lawsuit claiming that the grocery delivery platform misclassified its shoppers.

The settlement benefits Instacart shoppers who were classified as independent contractors when performing work in California between Sept. 13, 2015, and Dec. 15, 2020.

San Diego City Attorney Mara W. Elliot filed a lawsuit against Instacart in September 2019, claiming the grocery-delivery service misclassified its shoppers as independent contractors. Based on the scope of their work and other factors, these shoppers should have been classified as employees, the lawsuit contends.

Instacart is a grocery-delivery service. Instacart “shoppers” shop for grocery orders at various stores, then drop these orders off at the customer’s home. Consumers who use Instacart may also be interested in delivery from Drizly.

Instacart hasn’t admitted any wrongdoing but agreed to a $46.5 million settlement with the San Diego city attorney to resolve the misclassification class action lawsuit.

Under the terms of the Instacart class action lawsuit settlement, shoppers can receive a proportional share of the settlement fund based on the number of hours they worked in California during the settlement period.

Exact payments will vary, but each claimant will receive at least $10.

There is no exclusion or objection deadline for this settlement.

No final approval hearing will be held.

In order to receive a settlement payment, Instacart shoppers must submit a valid claim form by Aug. 31, 2023.
